Velora Terms of Service

1. Acceptance of Terms

By downloading, installing, or using Velora (the "Application"), you ("User", "you") agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Application. These Terms constitute a legally binding agreement between you and Doğaç Oğuz ("Developer", "we", "us").

2. Description of Service

Velora is a health and fitness tracking application for iOS that integrates with Apple Health to provide workout analytics, activity tracking, and AI-generated fitness insights. The core Application is free. An optional auto-renewable subscription, Velora Pro, unlocks additional features (currently iCloud backup and alternate app icons; the set of features included in Velora Pro may change over time).

3. Feature Availability

Some features depend on your device and on services operated by Apple:

• AI insights require a device, operating system version, and language supported by Apple Intelligence. Where Apple Intelligence is unavailable, the Application shows rule-based content or no insight
• iCloud backup depends on your own iCloud account and its available storage
• The Developer is not responsible for the availability, performance, or changes of Apple services, including Apple Health, Apple Intelligence, iCloud, and the App Store

4. Eligibility

You must be at least 13 years of age (or 16 in the European Economic Area) to use this Application. By using the Application, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.

5. User Responsibilities

You are responsible for:

• Maintaining the security of your device and Apple ID
• Ensuring the accuracy of health permissions you grant
• Using the Application in compliance with all applicable laws
• Any actions taken based on information provided by the Application

6. Subscriptions and Payments

Velora Pro is offered as a monthly plan and an annual plan. Both are auto-renewable subscriptions purchased through the Apple App Store and billed to your Apple ID.

• Prices: Prices are shown in the App Store at the time of purchase and may vary by region and currency
• Free trial: The annual plan may include a free trial (currently 7 days) for eligible new subscribers. The trial converts to a paid subscription unless you cancel at least 24 hours before it ends
• Automatic renewal: Subscriptions renew automatically at the end of each period unless auto-renew is turned off at least 24 hours before the end of the current period. The renewal is charged to your Apple ID within 24 hours before the current period ends
• Managing and cancelling: You manage or cancel your subscription in your Apple ID account settings. Deleting the Application does not cancel a subscription
• Refunds: Refunds are handled by Apple under the App Store terms. The Developer cannot issue refunds
• Restoring purchases: Use "Restore Purchases" in the Application's Settings to recover your entitlement on a new device
• Family Sharing: Family Sharing applies where Apple enables it for the subscription
• Price changes: Price changes are communicated in advance according to Apple's rules, and you may cancel before they apply

The software licence for the Application is Apple's standard Licensed Application End User License Agreement, available at https://velorahealthcompanion.com/eula. These Terms supplement that licence.

9. Assumption of Risk

Physical exercise and fitness activities carry inherent risks, including but not limited to the risk of physical injury, disability, and death. By using the Application to guide, track, or inform your fitness activities, you:

• Acknowledge that you are aware of these risks
• Voluntarily assume all risks associated with physical exercise, dietary changes, and any other activities undertaken in connection with information provided by the Application
• Accept sole responsibility for your physical condition and well-being

10. Warranty Disclaimer

THE APPLICATION IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• IMPLIED WARRANTIES OF MERCHANTABILITY
• FITNESS FOR A PARTICULAR PURPOSE
• NON-INFRINGEMENT
• ACCURACY, RELIABILITY, OR COMPLETENESS OF CONTENT
• UNINTERRUPTED OR ERROR-FREE OPERATION

The Developer does not warrant that the Application will meet your requirements, that results obtained from using the Application will be accurate or reliable, or that defects will be corrected.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE DEVELOPER BE LIABLE FOR ANY:

• Indirect, incidental, special, consequential, or punitive damages
• Loss of profits, data, use, goodwill, or other intangible losses
• Damages arising from personal injury or physical harm
• Damages resulting from unauthorized access to or alteration of your data
• Damages arising from any AI-generated content or insights

IN ANY CASE, THE DEVELOPER'S TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE AMOUNT YOU HAVE ACTUALLY PAID FOR THE APPLICATION THROUGH THE APP STORE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ZERO (USD $0.00) IF YOU HAVE NOT MADE ANY PAYMENTS.

12. Indemnification

You agree to indemnify, defend, and hold harmless the Developer, Doğaç Oğuz, from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from:

• Your use of or inability to use the Application
• Your violation of these Terms
• Your violation of any third-party rights
• Any actions taken based on information, insights, or AI-generated content provided by the Application

13. Release and Hold Harmless

You hereby release, waive, and forever discharge the Developer from any and all liability, claims, demands, actions, and causes of action whatsoever, directly or indirectly arising out of or in connection with your use of the Application, including but not limited to any liability arising from:

• Personal injury, illness, disability, or death
• Property damage
• Emotional distress
• Reliance on AI-generated content or health information
• Inaccurate or incomplete data from Apple Health or third-party services

14. Intellectual Property

All intellectual property rights in the Application, including but not limited to design, code, graphics, logos, and user interface, are owned by the Developer. You may not copy, modify, distribute, reverse engineer, or create derivative works based on the Application without prior written consent.

15. Termination

The Developer reserves the right to terminate or suspend your access to the Application at any time, for any reason, without prior notice. Upon termination, all rights granted to you under these Terms will immediately cease. Sections 7 through 13 (disclaimers, liability, indemnification, release) shall survive termination.

16. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Republic of Turkey, without regard to its conflict-of-law provisions. Any disputes arising out of or relating to these Terms or the Application shall be subject to the exclusive jurisdiction of the courts of the Republic of Turkey.

17. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

18. Changes and Entire Agreement

We may update these Terms periodically. The current version is always published at https://velorahealthcompanion.com/terms-of-service/, and we update the Effective Date at the top of this page when it changes. Continued use after changes constitutes acceptance of the revised Terms.

These Terms, together with the Velora Privacy Policy (https://velorahealthcompanion.com/privacy-policy/) and Apple's Licensed Application End User License Agreement, constitute the entire agreement between you and the Developer regarding the use of the Application and supersede all prior agreements and understandings.
